Terms of Service

1. Eligibility

The Services are intended only for individuals who are at least 16 years old or the higher minimum age required by local law and who can enter into binding contracts. We may require additional proof of age, identity, residence or eligibility before certain features, offers or payouts may be used.

Only one account per person and, as a rule, only one account per household is permitted unless we expressly approve otherwise in writing.

2. Account and Security

You must provide accurate, complete and current information and keep your password and other access credentials confidential. You are responsible for all activities that occur through your account.

We may suspend, restrict, review or close accounts if we detect indications of abuse, false information, multi-accounting, circumvention, prohibited automation, security incidents or violations of these Terms of Service.

3. Rewards, Offers and Partner Content

Lootday may provide access to offers, surveys, games, cashback, shopping, coupon, download, installation, registration, purchase or other rewards opportunities. These opportunities may be provided in whole or in part by third parties, including BitLabs/Prodege, CPX Research, ayeT-Studios and other offerwall, survey, advertiser, research or rewards partners.

Rewards may be displayed as points, coins, credits or in another format. Unless expressly stated otherwise, unredeemed rewards have no cash value, are non-transferable, do not accrue interest and may only be used in accordance with these Terms of Service and the applicable redemption rules.

4. When Rewards Are Credited

Rewards are credited only if an offer or other reward activity is fully, properly and timely completed in accordance with all applicable conditions and the underlying conversion is successfully tracked, validated and finally approved by us or the relevant partner.

Mere participation, a click, an install or a provisional status display does not create a right to a final reward credit. Rewards may be denied, held, reversed or removed if:

• an offer was not completed properly,
• tracking, attribution or validation fails,
• participation was invalid, duplicate, fraudulent or abusive,
• a partner rejects, cancels, reverses or otherwise invalidates a conversion,
• an advertiser or partner does not pay,
• technical, compliance or risk reviews require it.

5. Disclosure of Material Offer Terms

Before participating in an offer or other rewarded activity, you should always review the material terms. These may include in particular:

• required steps or minimum milestones,
• deadlines, waiting periods or hold periods,
• country, age, device or new-user requirements,
• disqualification criteria,
• required consent for tracking or cookies,
• special terms of the advertiser, survey provider or offerwall partner,
• reward amount and possible variations or currency conversions.

Where a third-party partner imposes additional terms, those terms apply in addition. In case of conflict, the specific terms of the relevant offer may prevail.

6. Redemptions and Payouts

Rewards may only be redeemed through the payout or redemption methods made available by Lootday. Minimum thresholds, processing times, availability limits, country restrictions, fees, currency conversion and additional checks may apply.

Redemptions and payouts may be delayed where necessary for validation, security reviews, fraud checks, partner reconciliation, chargeback risk, legal obligations or technical clarification.

To the extent permitted by law, completed redemptions are generally final. However, we may reverse, correct or replace a payout if a payout fails, a partner reverses, a technical error occurs or abusive use is detected.

7. Identity and Eligibility Verification

Before crediting, redeeming or paying rewards, or when using certain features, we may require you to verify your identity, age, place of residence, phone number, payment method or other eligibility criteria.

For this purpose, we may request information ourselves or through third-party service providers, such as:

• email or SMS confirmation,
• submission of a government ID,
• selfie or liveness checks,
• proof of ownership of a payment method,
• tax or regulatory information.

If you do not provide requested information, or provide it late or incompletely, we may deny, hold, reverse or cancel credits, redemptions, payouts or access to parts of the Services.

8. Consent, Privacy Settings and Offer Availability

Certain offers, surveys, offerwalls or tracking functionality require you to provide the necessary consent or allow certain privacy settings. If you refuse, withdraw or opt out of such consent, some features, offers or rewards opportunities may become unavailable in whole or in part.

You acknowledge that certain third-party partners can validate rewards only if technically necessary identifiers, tracking signals or event data may lawfully be processed.

9. Prohibited Use

You must not use the Services unlawfully or abusively. Prohibited conduct includes in particular:

• multi-accounting, account sale, account rental or account sharing,
• false information or identity concealment,
• use of bots, scripts, automation, emulators, device farming, simulated installs or other artificial interaction,
• use of VPNs, proxies, manipulated devices, spoofing or circumvention methods,
• manipulation of tracking, offer flows, surveys, incentives, referrals or payout processes,
• participating in offers not intended for you,
• abusive complaints, chargebacks or other circumvention attempts,
• infringing third-party rights or applicable law.

10. Communications

You agree that we may send service-related communications, including messages about account security, rewards, offers, payouts, changes to terms, support or technical notices. These communications are necessary for operating the Services and cannot be fully unsubscribed from.

Marketing messages are sent only to the extent permitted by law. You may opt out of marketing communications at any time with future effect.

11. Taxes

You are responsible for determining whether rewards, redemptions or payouts are taxable in your jurisdiction and for complying with any related tax, reporting or payment obligations. We may request additional information where needed for tax or regulatory purposes.

12. Suspension, Reversal and Termination

We may temporarily or permanently restrict, suspend or terminate your account or specific features if we reasonably believe that:

• you have violated these Terms of Service,
• abusive, fraudulent or unlawful use has occurred,
• a partner requests that a user be blocked,
• security, compliance or regulatory reasons require it,
• technical or operational reasons make it necessary.

In such cases, we may hold, cancel or cause the forfeiture of pending rewards to the extent legally permitted and reasonably justified.

13. Third-Party Content and External Terms

Our Services may include or link to third-party content, websites, apps, offers and services. We are not responsible for those third-party offerings. Third parties may have their own terms and privacy policies, which you should review carefully before use.

14. Availability and Changes

We may modify, expand, limit, pause or discontinue the Services or parts of them at any time. We do not guarantee uninterrupted availability, any specific number of offers or surveys or any particular reward amount.

15. Liability

To the extent permitted by law, we are liable only for intent and gross negligence and for culpable injury to life, body or health. In the event of slightly negligent breach of essential contractual obligations, our liability is limited to the typical foreseeable damage. Otherwise, liability is excluded.

In particular, we are not liable for the availability, content, rejections, reversals, validation decisions or privacy practices of third-party partners to the extent they are outside our sphere of responsibility.

16. Changes to these Terms

We may amend these Terms of Service from time to time. The current version will be published through our Services. Where changes are material, we will provide additional notice to the extent required by law. Your continued use after the changes take effect constitutes acceptance to the extent legally permitted.
